DUNOVSKÁ & PARTNERS succeeded in proceedings for one hundred million CZK

DUNOVSKÁ & PARTNERS succeeded in proceedings for one hundred million CZK at the Supreme Court of the Czech Republic. The office represented a major banking client before the Supreme Court of the Czech Republic, which granted the office's appeal and annulled the earlier decision of the Court of Appeal. The Supreme Court agreed with the legal opinion of the office that the assessment of the bank's liabilities from the bank guarantee is governed by formalistic principles, even to the extent of deciding whether the bank guarantee has taken effect. Such formalistic approach applies even to the extent of conditions for effectiveness of the guarantee.
