Representation of ČSOB a.s. in Insolvency and Restructuring Proceedings

Represented ČSOB in civil, insolvency, and restructuring proceedings against a freight forwarding company and its affiliated entities, including the assessment of non-standard transactions carried out prior to insolvency. Case value CZK 500 million. This representation should enable maximum protection and effective enforcement of claims in the insolvency proceedings.

Advising Česká spořitelna a.s. on a Distressed Loan

Provided legal representation to Česká spořitelna in a case involving a distressed loan exposure to a manufacturing company. Services included documentation analysis, collection management, and representation in insolvency proceedings. Our assistance enabled the bank to effectively protect its interests and maximize recovery of a claim for CZK 119 million in a complex insolvency case.

Advising HSBC on Resolving Credit Exposure

Assisted HSBC Continental Europe in resolving credit exposure involving ŠKODA MACHINE TOOL amounting to CZK 1.25 billion. Documentation adjustments enabled the bank to respond flexibly to the client's needs while maintaining adequate security.

Advising and Representing a Banking Group in Loan Restructuring

Represented a group of banks (ČS, ČSOB, KB, SBCZ, UCB) in restructuring loans to REDA for CZK 373 million. The preparation of a stabilization agreement allowed the banks to coordinate their protection of claims and provide the debtor with space for financial stabilization.

Advising Česká spořitelna a.s. on Loan Recovery

Provided advice to Česká spořitelna in recovering claims against Pietro Filipi amounting to CZK 50 million. Our comprehensive approach led to full satisfaction of the bank's claims through the sale of pledged assets.

Representing ČSOB a.s. in Bank Guarantee Disputes

Provided legal advice and representation to ČSOB in a dispute over bank guarantees for CZK 500 million. Our successful representation resulted in a decision by the Supreme Court of the Czech Republic in favor of the bank. This victory protected significant financial resources for the client and established an important legal precedent in the area of bank guarantees.

Advising Investcrown s.r.o. on Loan Restructuring

Assisted the Investcrown platform in restructuring loans exceeding CZK 100 million in the food sector. Structuring the transaction and preparing documentation enabled the client to successfully restructure problematic loans and preserve the viability of the financed enterprise.

Legal Advice to Česká spořitelna a.s. on Risk Mitigation

Advised Česká spořitelna during an M&A process for a client with a CZK 303 million loan. The preparation of documentation for a joint sale of shares and assignment of claims enabled the bank to safely exit a risky exposure while supporting its client’s M&A transaction.

Advising Česká spořitelna a.s. on Loan Recovery

Provided comprehensive advice to Česká spořitelna in recovering claims against KARA Trutnov amounting to CZK 170 million. Organising the sale of claims led to a swift and effective resolution of the bank’s problematic exposure.

Advising HSBC on Non-Recourse Factoring

Provided legal assistance to HSBC Continental Europe in handling non-recourse factoring of CZK 250 million for a leading mobile phone distributor. Our advice enabled the bank to efficiently manage risks associated with this form of financing.
